Terms of Service

The terms on which you may use this website and client portal, and the basis on which Unflawed Marketing Ltd provides services.

1. Who we are and what these terms cover

This website and the client portal are operated by Unflawed Marketing Ltd ("we", "us", "our"), registered in England and Wales with company number [COMPANY NUMBER] and registered office at [REGISTERED ADDRESS], United Kingdom.

These terms govern your use of the website and portal. By using them you accept these terms; if you do not accept them, please do not use the site. Services themselves are provided under a separate written client agreement, which takes precedence over these terms to the extent of any conflict.

2. The website and the marketing readiness check

Content on this site is provided for general information about our services. It does not constitute professional advice on which you should rely without discussing your specific circumstances with us.

Our marketing readiness check analyses publicly available pages of the website you submit, together with the answers you provide. Scores and findings are automated estimates based on observable evidence and your own declarations. They are indicative, not a guarantee of any outcome, and may not reflect data we cannot access, such as your analytics, advertising accounts or CRM.

You must only submit a website you own or are authorised to have analysed.

3. Services, proposals and pricing

Services are provided under a written agreement covering scope, fees, term, notice and ownership. Nothing on this website forms part of that agreement or constitutes an offer capable of acceptance.

Pricing shown on this site is indicative of our standard engagement and subject to scope. Advertising spend is paid directly by you to the advertising platforms and is separate from our management fees. Unless expressly agreed in writing, we do not hold or handle your advertising budget.

4. Client accounts and the portal

You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised access.

Reports, schedules and messages in the portal are provided for your business use. You must not misuse the portal, attempt to access another client's data, or interfere with the operation of the service.

We may suspend access to the portal where reasonably necessary for security, maintenance or breach of these terms.

5. Payment, minimum term and cancellation

Our services are provided to businesses only. By engaging us you confirm you are acting for business purposes, so consumer cancellation rights do not apply.

Where you pay through a payment link we issue, payment is processed by Stripe and is also subject to Stripe's terms. Your engagement begins on receipt of the first payment. Fees exclude VAT where applicable, and late payments may attract interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

Every engagement has a minimum initial term stated in your client agreement (typically four months). You cannot cancel for convenience during the minimum term. You may submit a cancellation request through your client portal; our team will respond within 2 working days, and fees for the rest of the minimum term remain due unless we agree otherwise in writing.

After the minimum term, services continue monthly. You can cancel through the portal with 30 days' notice, taking effect at the end of the paid billing period. Cancelling a card or payment method outside this process does not end the agreement or fees already due.

If a payment fails, we may pause work until the account is brought up to date. Refunds are at our discretion except where required by law.

6. No guarantee of results

Marketing performance depends on factors outside our control, including your market, offer, pricing, capacity, and how quickly enquiries are handled within your business. We do not guarantee any particular number of enquiries, appointments, customers, rankings or any specific financial return, and nothing on this site or in any report should be read as such a guarantee.

7. Intellectual property

The content, design and structure of this website belong to us and may not be reproduced without permission. Ownership of work produced for clients — including websites, campaigns, automations and documentation — is set out in the relevant client agreement.

You retain ownership of your own data, content and accounts at all times.

8. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.

Subject to that, we are not liable for any indirect or consequential loss, loss of profit, revenue, data or business opportunity arising from use of this website, the portal or the readiness check. Our total liability arising from or in connection with this website is limited to £100; liability for services is governed by, and limited under, the client agreement.

9. Third-party services and links

Our services rely on third-party platforms (for example advertising platforms, payment processors and email providers). We are not responsible for the acts, omissions, outages or policy changes of those platforms, and your use of them is subject to their own terms.

9A. Signed agreements and electronic signature

Clients, freelance team members and referral partners each sign a written agreement (the Client Services Agreement, the Freelance Contractor Agreement or the Referral Partner Agreement). Where a signed agreement conflicts with these terms, the signed agreement wins.

Agreements are signed electronically in the portal. We record the signer's typed name, the time, IP address, device and a fingerprint of the exact text, and email a signed PDF. Electronic signatures are valid under the Electronic Communications Act 2000 and UK eIDAS. Signers also confirm they have read our Privacy Notice.

When we issue a new version of an agreement or a new document, it is shown the next time you sign in. Existing signed versions remain in force until the new one is signed or the agreement ends under its own terms.

10. Changes and contact

We may update these terms from time to time; the version on this page is current. Continued use of the site after a change constitutes acceptance.

Questions about these terms: info@unflawed.uk.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
